MIL SPEC TRAINING AIDS LIMITED WARRANTY AND DISCLAIMER
Mill Spec Training Aids warrants each Mil Spec Training Aid to be free from defects in materials and workmanship only.
Mil Spec Training Aids obligation under this warranty shall be limited to replacement (ONLY) of any Mil Spec Training Aid returned (prepaid) to us and if found to be defective after inspection in either material or workmanship, the Mil Spec Training Aid item will be replaced free of charge including postage.
Mil Spec Training Aids reserves the right to make charges at any time with specifications or design without notice.
Mil Spec Training Aids may add or remove accessory materials and add or discontinue models without notice or incurring obligation.
This Limited Warranty gives you specific legal rights and you may also have other rights, which may vary from state to state. This Limited Warranty and Statement of Liabilities supersede all previous warranties and commitments.
DISCLAIMER OF ALL IMPLIED WARRANTIES AND STATEMENT OF LIABILITIES
The parties agree that this instrument constitutes the entire warranty agreement between the parties, superseding all previous communications, oral or written, and no changes, amendments, or additions hereto will be recognised unless in writing signed by both Mil Spec Training Aids and the customer.
It is expressly agreed by both parties that no representations or warranties, expressed or implied, have been or are made by Mil Spec Training Aids except as stated herein, and Mil Spec Training Aids makes NO WARRANTY, EXPRESSED OR IMPLIED, AS TO ANY IMPLIED WARRANTY OF MERCHANTABILITY OR AS TO ANY IMPLIED WARRANTY OF FITNESS FOR ANY PARTICULAR PURPOSE, or with respect to any other obligation or liability on the part of Mil Spec Training Aids.
The laws of the state of Queensland Australia shall govern construction and interpretation of this warranty.
The exclusive remedy for claims arising hereunder shall be for damages. The liability of Mil Spec Training Aids for any and all loss or damage resulting from any cause whatsoever including the negligence of Mil Spec Training Aids and for alleged or defective goods, irrespective of whether such defects are discoverable or latent, shall in no event exceed the price of particular Mil Spec Training Aid, the replacement of defective or damaged equipment.
Mil Spec Training Aids accept no responsibility in anyway whatsoever for loss of life and or injury when using or misusing Mil Spec Training Aids and the customer indemnifies Mil Spec Training Aids against such claims and or damages whatsoever in anyway.
SECURITY DEPOSITS FOR HIRE ONLY PRODUCTS
SECURITY DEPOSITS FOR HIRE PRODUCTS, THE FULL SECURITY DEPOSIT WILL BE FORFEITED IF THE HIRE
PRODUCTS ARE RETURNED WITH ANY DEFECTS OR DAMAGE IN ANY WAY (NO EXCEPTIONS)
Your submittal of any purchase order from Mil Spec Training Aids Product Store indicates acceptance of these above terms and conditions. These terms and conditions shall supersede any subsequent terms or conditions included with any purchase order.
IN NO EVENT, INCLUDING THE CASE OF A CLAIM OF NEGLIGENCE, SHALL MIL SPEC TRAINING AIDS BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING IN CONNECTION WITH THE USE OR INABILITY TO USE MIL SPEC TRAINING AIDS.
